An Estate Sale is a process by which a person's assets are liquidated, usually due to death or bankruptcy and navigating the intricacies of estate home sales in Ontario requires a refined touch, deep market knowledge, and a comprehensive understanding of legal procedures. As a Realtor with 24 years of experience in the Halton, Hamilton and GTA Real Estate industry, I have had the privilege of handling many such sophisticated transactions with finesse and expertise.

WHAT IS PROBATE

Probate is the Court procedure for:

  1. Approval of the will by the Court as the last will of the deceased (if there is a will).
  2. Whether there is a will or not, appointment of the person who will act as the Executor of the Estate. 

Probate is the Court process that gives the Estate Trustee the authority to act on behalf of the deceased and administer the deceased estate. This process needs to be completed BEFORE the home can be sold. You can’t transfer title to the will and sell the home without probate.

Assets in joint tenancy with a right of survivorship do not need to be probated. On the death of one co-owner, they no longer own any interest in the property. The other co-owner becomes the sole owner outright.

When an estate transfers from the deceased spouse to the surviving partner, it's often not subject to probate, particularly when there's no actual estate to administer. This scenario typically arises if the couple owned a home as joint tenants with the right of survivorship, and the surviving spouse is the named beneficiary of financial assets like pensions, life insurance, RRSPs, or TFSAs. In such instances, the real estate automatically passes to the surviving joint tenant, becoming their sole property. 

However, when estate transfer occurs between generations, such as from parents to children, probate is usually required. Some individuals try to bypass probate by using beneficiary designations. While this strategy is feasible and can be effective, it also bears significant risks of disputes over the estate. Generally, this approach is not advised unless the entire estate is being transferred to a single adult child.
